Environmental Appeals Board hearing schedule: Howells Excavating Ltd.
The Environmental Appeals Board will conduct a virtual hearing on September 22, 23, 24, 29 and October 1, 2026.
The Board will hear submissions in relation to the decisions of the Director, Alberta Environment and Protected Areas to issue Water Act Licence No. 00432249-00-00 and Water Act Approval Nos. DAUT0012377, DAUT0012378 and DAUT0012379 to Howells Excavating Ltd. for the purposes of aggregate extraction. The Approvals authorize Howells Excavating Ltd. to disturb groundwater, construct berms for flood control purposes, and develop two end pit lakes at SE-13-26-2-W5, in Red Deer County. The Licence authorizes the operation of a works and the diversion of up to 21,000 cubic metres of water per year at a maximum rate of 0.075 cubic metres per second from the Red Deer River SE13-36-2W5.
Any person, other than the parties, who wishes to make a representation before the Board on these appeals must submit a request in writing by fax or by e-mail to the Board at the fax number or e-mail address set out below. The request must be received by the Board on or before August 7, 2026. It is your responsibility to ensure that your request is received by the Board by August 7, 2026. Such a request shall (a) contain the name, address, e-mail, and telephone and fax numbers of the person submitting the request, (b) indicate whether the person submitting the request intends to be represented by a lawyer or agent and, if so, the name of the lawyer or agent, (c) contain a summary of the nature of the person’s interest in this appeals, and (d) be signed by the person submitting the request. Applications will only be considered if the information will assist the Board in making its decision, and will not duplicate the information provided by the parties. After August 7, 2026, the Board will, in its discretion, determine if other persons may make representations, and the manner in which they can be made. Once the Board makes a decision on intervenor applications the hearing will be open to the public for viewing only.
The Environmental Appeals Board is a separate and independent body that reviews certain decisions made by Alberta Environment and Protected Areas. The Board is composed of environmental experts from a variety of disciplines.
